US denies visas to people fearful of returning home

The United States government has introduced new visa requirements. These rules affect many people globally. This includes many LGBTQ+ individuals who cannot safely return home.

The State Department has issued new instructions to embassies and consulates. Diplomatic staff must now pose a new question to visa applicants. They must ask if applicants fear returning to their home country.

If applicants answer yes, their visa will be rejected. This represents a major shift in US immigration policy. It affects people applying for tourist, student, and work visas.

This policy is particularly damaging for LGBTQ+ people. Many LGBTQ+ individuals live in countries where danger exists. In over 60 countries, same-sex relationships remain illegal. In some countries, LGBTQ+ people face imprisonment or death.

These individuals often travel to safer countries seeking protection. Some attend LGBTQ+ events or pursue medical care abroad. Others simply wish to visit family in safer nations.

Under previous rules, fear of returning home was not visa grounds for denial. The new rules completely change this approach. Now honesty about safety risks means losing your visa.

Human rights organisations are deeply concerned about this policy. They argue it punishes people for telling the truth. Activists warn that LGBTQ+ people may now provide false information on applications.

Immigration lawyers also oppose the new rules. They say the policy conflates visa applications with asylum requests. A nonimmigrant visa differs from asylum or refugee status requests.

Critics argue the Trump administration uses fear to reduce immigration numbers. LGBTQ+ rights groups say this policy directly targets vulnerable populations. Many of these individuals already experience violence and discrimination at home.

The new rules are already being implemented at US embassies worldwide. There is no clear appeals process for denied applicants. Advocacy groups are urging Congress to challenge the policy immediately.
